  • Summary

    Allison Cherry Lafferty is experienced in all phases of litigation. Her practice focuses on commercial, real estate, products liability and construction litigation.  Ms. Lafferty is well versed in complex commercial litigation, including class action defense and contract disputes.  She represents a variety of businesses in planning and in litigation through trial.  She has extensive experience, through trial, representing manufacturers and distributors in products liability litigation.  Ms. Lafferty’s practice includes representing businesses, farmers and landowners in a variety of contract and real estate disputes.  Her representation of contractors and builders, spans from business advice to litigation and mechanics’ liens.  She has also defended the firm’s hospital and physician clients in medical malpractice claims. 

    Ms. Lafferty is currently the firm’s Managing Shareholder.

    Representative Matters

    • Represented partner in defense of claim for breach of fiduciary duty. Obtained Judgment for the Defense after a 7-day court trial.

    • Represents clients in a variety of real estate matters, including failure to disclose disputes real estate transactions.

    • Represents developers in the construction portion of development.

    • Represents walnut processors in business litigation issues.

    • Represents trustees and beneficiaries in probate and trust litigation.

    • Represented large wine grape grower in contract dispute with winery that resulted in a mediated resolution and maintained relationship.

    • Represents business owners in business dissolution and buy-out disputes.

    • Represented medical group in business dissolution dispute through successful mediated resolution.

    • Represented subcontractor in five multi-project construction collection actions against large residential developer and its lenders, in Contra Costa County Superior Court.

    • Represented restaurant owner/cross-complainant and obtained verdict for client after three-week court trial, including an award of delay damages, in San Joaquin County Superior Court.

    • Represented numerous subcontractors in construction defect litigation.

    • Represented residential developer in 46-home construction defect litigation and obtained favorable settlement through mediation.

    • Represented walnut grower in obtaining specific performance of an option contract to purchase 81 acres in Riverbank.

    • Successfully defended a large regional pest control company in a jury trial in Sacramento County involving allegedly negligent termite inspections and unfair competition.

    • Represented defendant manufacturer of a tractor trailer and obtained defense verdict after three-month jury trial with multimillion-dollar exposure, in San Joaquin County Superior Court.

    • Successfully defeated class certification in a multimillion-dollar unfair competition and false advertising case in Contra Costa County, including appeal.

    • Represented a hospital in a libel action and obtained a defense verdict after a two-week jury trial, in Merced County Superior Court.

    • Represented a large-scale tomato grower in class action arbitration and obtained favorable settlement for grower.

    • Represented the distributer of a safety chain used to secure a trailer and obtained judgment in client’s favor after two-week court trial via a Motion for Judgment/Nonsuit.

    • Ms. Lafferty currently serves on the Board of Directors of Oak Valley Bancorp and its wholly-owned subsidiary Oak Valley Community Bank.

    • Ms. Lafferty is a frequent speaker on non-profit board governance at the Westgate Center.

    • Ms. Lafferty is a member of the Trial Attorneys of America and has been a speaker at its annual meeting in Chicago, Illinois.

    • Ms. Lafferty was named a Northern California Super Lawyer® Rising Star in Civil Litigation by San Francisco Magazine in 2013 and 2014.
